Agreement to Terms
By using the services provided by ApexGuard Palmview Towing, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. We reserve the right to modify these terms at any time, and your continued use of our services constitutes acceptance of any changes.
Services Provided
ApexGuard Palmview Towing provides towing and roadside assistance services in Palmview, TX and surrounding areas. Our services include but are not limited to emergency towing, flatbed towing, long-distance towing, motorcycle towing, accident recovery and winching, junk car removal, heavy-duty towing, and roadside assistance such as jump starts, tire changes, and lockout services.
Service Requests and Payment
When you request our services, you agree to pay all applicable fees and charges. Payment is due at the time of service unless other arrangements have been made in advance. We accept cash, credit cards, and insurance billing where applicable. You are responsible for verifying your insurance coverage before service is rendered. If your insurance does not cover the full cost of service, you are responsible for the remaining balance.
Customer Responsibilities
You are responsible for providing accurate information about your vehicle and location when requesting service. You must have proper authorization to request towing services for the vehicle in question. This typically means you must be the registered owner or have written permission from the owner. You agree to remove all personal belongings from your vehicle before it is towed. ApexGuard Palmview Towing is not responsible for items left in vehicles.
Liability and Insurance
ApexGuard Palmview Towing carries comprehensive liability insurance and takes all reasonable precautions to protect your vehicle during towing and transport. However, we are not liable for pre-existing damage, mechanical failures, or damage resulting from the condition of your vehicle. We are not responsible for damage caused by circumstances beyond our control, such as severe weather, road conditions, or third-party actions. Any claims for damage must be reported within 24 hours of service.
Cancellations and No-Shows
If you need to cancel your service request, please contact us as soon as possible. Cancellations made after our driver has been dispatched may be subject to a cancellation fee to cover the cost of travel and time. If you are not present at the pickup location when our driver arrives and cannot be reached by phone, you may be charged a no-show fee.
Storage and Impound
If your vehicle is towed to our storage facility or an impound lot, you agree to pay all applicable storage fees. Storage fees accrue daily and are separate from towing charges. You are responsible for retrieving your vehicle in a timely manner. Vehicles left in storage for extended periods may be subject to lien and sale procedures as allowed by Texas law.
Dispute Resolution
If you have a dispute regarding our services or charges, please contact us immediately at (956) 476-0463 or hello@palmviewtowing.com. We are committed to resolving disputes fairly and quickly. Any legal disputes that cannot be resolved through direct communication will be subject to the laws of the State of Texas and will be resolved in the courts of Hidalgo County, Texas.
Limitation of Liability
To the fullest extent permitted by law, ApexGuard Palmview Towing is not liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability for any claim related to our services is limited to the amount you paid for the specific service in question.
